Swissness Self-Declaration

1. Subject of the Declaration

The undersigned company (hereinafter referred to as “the Label Holder”) hereby declares that all products placed on the market under the organic label of the association «LuxAgro» and carrying a Swiss origin indication (e.g. "Swiss Product", Swiss cross, typical Swiss symbols) fully comply with the requirements of Swiss legislation on the use of Swiss origin indications (the so-called "Swissness" legislation, including but not limited to Art. 47 et seq. of the Swiss Trade Mark Protection Act, TmPA, and the related ordinances, in particular the Swissness Ordinance, SR 232.112.1), especially the Trade Mark Protection Act (TmPA) and the corresponding ordinances.

2. Confirmation of the Legal Criteria

The Label Holder confirms compliance with the following criteria relevant to its products:

For unprocessed natural products (e.g. vegetables, fruit, eggs, meat):

• The place of harvest (for plant products) or the place where the animals have spent the majority of their lives (for animal products) is exclusively in Switzerland.

For processed food products (e.g. jam, cheese, sausage, bread):

• At least 80% of the weight of the raw materials that make up the product originate from Switzerland. (Exceptions for raw materials that are not available in Switzerland, or not available in sufficient quantities, are handled in accordance with the legal provisions).
• The processing that gives the product its essential characteristics (e.g. the transformation of milk into cheese, the baking of bread) takes place exclusively in Switzerland.

3. Documentation and Disclosure Obligations

The Label Holder undertakes to maintain complete documentation that proves compliance with the Swissness criteria for each product sold under the label at all times (e.g. delivery notes, recipes, product flow calculations). Upon request by the association or its control bodies, this documentation must be disclosed at any time. The Label Holder provides truthful and complete information on the origin of its raw materials and the places of processing.

4. Liability

The Label Holder assumes full legal and financial responsibility for the accuracy of its origin declarations. The Label Holder is aware that false or misleading declarations may not only have civil and criminal consequences, but also, in accordance with the label regulations, lead to the immediate withdrawal of the right to use the label and to exclusion from the association.
The Label Holder shall fully indemnify the association against any damages (including reputational damage, fines or legal costs) incurred by the association as a result of a breach of the Swissness legislation by the Label Holder.

5. Notes

This declaration serves as internal assurance or as an attachment for business partners, importers or authorities. A review by the Swiss Federal Institute of Intellectual Property (IPI), the federal government, the state or third parties may be required. A self-declaration does not replace a trademark registration if “Swiss” or “Switzerland” is used as a brand.
